This document aims to establish the General Terms of Use for the mobile applications owned by FDPApps. FDPApps reserves the right to modify these Terms of Use in order to comply with the current applicable legislation at any given time. These Terms of Use do not exclude the possibility that certain services of the applications, due to their specific characteristics, may be subject not only to the General Terms of Use but also to their own specific terms of use (hereinafter referred to as the Specific Conditions). These changes will be published on the Website and in the Application(s) and will become effective from the moment of their publication. Consequently, the User must periodically review for any changes in these Terms, and whether there is express consent or not, if the User continues to use the Service after the publication, it implies acceptance and assumption of the changes. In case the User does not agree with the updated Terms of Use or Privacy Policy, they can choose to discontinue using the Service.

Accessing and downloading the application is free, except for the cost of the connection through the telecommunications network provided by the user's contracted access provider. Certain services are exclusive to our customers, and their access is restricted. The download and use of the application imply the user status (hereinafter referred to as the 'User') and imply reading, understanding, and accepting all the terms and conditions outlined herein.

USE OF MOBILE APPLICATIONS AND THEIR SERVICES

Not to introduce or disseminate content or propaganda of a racist, xenophobic, pornographic nature, or that promotes terrorism or infringes on human rights.

Not to introduce or disseminate data programs (viruses and harmful software) that could cause damage to the computer systems of the access provider, its providers, or third-party users of the Internet network.

Not to disseminate, transmit, or make available to third parties any type of information, element, or content that violates constitutionally recognized fundamental rights and freedoms and international treaties.

Not to disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes illegal or unfair advertising.

Not to transmit unsolicited or unauthorized advertising, advertising material, "spam," "chain letters," "pyramid schemes," or any other form of solicitation, except in areas (such as commercial spaces) specifically designed for this purpose.

Not to introduce or disseminate any false, ambiguous, or inaccurate information and content that misleads recipients of the information.

Not to impersonate other users using their registration keys for various services and/or contents of the Portals.

Not to disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes a violation of intellectual and industrial property rights, patents, trademarks, or copyrights belonging to the Portals' owners or third parties.

Not to disseminate, transmit, or make available to third parties any type of information, element, or content that constitutes a violation of communication secrecy and personal data legislation.

INTELLECTUAL AND INDUSTRIAL PROPERTY

FDPApps reserves all rights to trademarks, trade names, and other distinctive signs, patents, and intellectual property with respect to the content and design of the application. All content, including but not limited to texts, graphics, images, design, and intellectual property rights that may correspond to such content, as well as trademarks, trade names, or any other distinctive sign, are owned by FDPApps, and all rights are reserved. The trademarks, trade names, or distinctive signs are the property of FDPApps, and the download, access, and use of the application do not grant the User any rights over said trademarks, trade names, and/or distinctive signs.

DISCLAIMER OF WARRANTIES. LIABILITY

FDPApps does not guarantee the availability of access and continuous operation of this mobile application and its services at all times. Therefore, FDPApps will not be responsible, within the limits established by current legal regulations, for damages and harm caused to the User as a result of unavailability, access failures, and lack of continuity of this mobile application and its Services. FDPApps will only be responsible for the Services it provides itself and for the contents directly originated by the company and identified with its copyright. This responsibility will be excluded in cases where force majeure circumstances occur or in cases where the User's device configuration is not suitable for the proper use of the Internet services provided by FDPApps. The download, access, and use of the application on mobile devices or similar do not imply an obligation on the part of FDPApps to check for the absence of viruses, worms, or any other harmful computer elements. It is the User's responsibility to have suitable tools for the detection and disinfection of harmful software.

USER CONDUCT

FDPApps does not guarantee that Users of this mobile application will use its contents and/or services in accordance with the law, morality, public order, the General Terms and, where applicable, the Specific Conditions. Likewise, it does not guarantee the accuracy, completeness, and/or authenticity of the data provided by Users. FDPApps will not be indirectly or subsidiarily liable for damages and harm of any nature derived from the use of the Services and Contents of the application by Users or that may arise from the lack of truthfulness, accuracy, and/or authenticity of the data or information provided by Users, or from the identity impersonation of a third party carried out by a User in any kind of action through this mobile application. Therefore, the use of this application does not imply an obligation on the part of FDPApps to verify the truthfulness, accuracy, suitability, adequacy, completeness, and timeliness of the information provided through it. FDPApps is not responsible for decisions made based solely on information obtained from the application that result in damages to the User or third parties.

DURATION AND TERMINATION

The provision of services and/or content of this mobile application has an indefinite duration. Notwithstanding the foregoing, FDPApps is empowered to terminate, suspend, or unilaterally interrupt the provision of the service and this mobile application and/or any of the services, at any time and without prior notice, regardless of what may have been established in the corresponding specific conditions.
